Terms of use

The service

Tobin helps a business find creators, draft outreach in the business’s voice, and, if you enable it, send messages and follow-ups from the business’s own accounts through to a visit or a product shipment.

Tobin is a tool. It is not a talent agency, a law firm, or a guarantee that any creator will reply, visit, post, or collaborate. Results depend on your offer, your accounts, the people you reach, and platforms we do not control.

The product is in private beta. Features can change, break, or disappear. We may refuse or withdraw access at any time.

Automated agents

Parts of Tobin are automated, including AI models. Those systems find candidates, judge fit, write first messages, and can reply and follow up. They make mistakes. They can misread a profile, choose a poor fit, invent a detail, sound unlike you, or message someone you would have skipped.

If automatic sending is off, nothing goes out until you send it. If you turn automatic sending on, messages can leave your account without a person at Tobin reviewing each one. You set the offer, the voice, the hours, and the daily limit, and you can pause at any time. You are responsible for reviewing the setup and for what is sent in your name.

We may pause or stop sending, for one account or for everyone, if we believe a workflow is unsafe, broken, or likely to harm an account or a recipient. That is a safety measure, not a promise that we will catch every problem.

Your accounts

You keep ownership of your Instagram account, your Google account, and every other account you connect. You grant us permission to use those connections only to provide the service you turned on.

We do not ask for or store your Instagram password. Sending uses a hosted browser session. You sign in to Instagram yourself inside that session. The session cookies stay with our browser-session provider. They are not a copy of your password. A separate official Instagram connection, if you enable it, uses an encrypted token from Meta for the permissions you approve.

You must follow the terms of Instagram, Meta, Google, and any other platform you connect. Those platforms can limit, checkpoint, or disable accounts that automate activity or send unwanted messages. That risk is yours. Tobin is not responsible for a restriction, suspension, or loss of an account, followers, or reach.

What you are responsible for

• The truth of your business details and the offer you describe. The agent should not invent the offer, and you must not ask it to promise something you will not honor.
• Every message sent from your accounts, whether you pressed send or automatic sending was on.
• Who you contact, including not targeting minors and not contacting people you are not allowed to contact.
• Anti-spam and marketing rules that apply to you, including Canada’s anti-spam law (CASL) when a message is a commercial electronic message. You are responsible for permission where it is required, for identifying your business, and for honoring opt-outs.
• Disclosure rules for sponsored or gifted content, including Ad Standards in Canada and the FTC guides if you reach people in the United States. Tobin does not decide whether a collaboration needs a disclosure.
• Visits, shipments, payments, and any other deal you make with a creator. Those deals are between you and the creator.

Acceptable use

You will not use Tobin to:

• Send spam, scams, impersonation, harassment, or unlawful content.
• Contact people in a way that breaks Instagram’s or Meta’s rules, or to evade a limit or ban.
• Misrepresent who the message is from, or hide that a message is commercial when the law says you must say so.
• Upload or generate content that infringes someone else’s rights.
• Probe, disrupt, or resell the service, or use it to build a competing dataset of our private systems.
• Turn on automatic sending for an account you do not control.

Your content and creator information

You keep your business content: your name, offer, site, and the words you write. You give us a license to host, copy, and process that content, and the public creator information we collect for you, only to run and secure the service.

Public creator profiles, posts, and comments remain subject to the rights of the people who created them and to the platforms where they appear. We do not transfer ownership of that material to you. You may use what we show you inside the product to decide who to contact. You may not republish it as your own database.

Our service

Tobin, the software, the models’ configuration, and the look of the product belong to us and our licensors. We grant you a limited, revocable, non-exclusive right to use the service while these terms are in effect and your access is approved. You do not get any other rights in the product.

Third-party services

Instagram, Meta, Google, and our infrastructure providers are not our agents. Their terms and outages apply to the parts of the product that depend on them. We are not liable for a failure, change, or refusal by any of them, including a change that stops messages from sending.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT CREATOR MATCHES WILL BE ACCURATE, THAT MESSAGES WILL BE APPROPRIATE, THAT SENDING WILL BE UNINTERRUPTED, OR THAT A COLLABORATION WILL HAPPEN. YOU USE AUTOMATED OUTREACH AT YOUR OWN RISK.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOBIN AND ITS OPERATORS, SUPPLIERS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS, OR FOR ANY PLATFORM RESTRICTION, SUSPENSION, OR LOSS OF AN ACCOUNT, WHETHER OR NOT WE WERE ADVISED IT COULD HAPPEN, AND WHETHER THE CLAIM IS IN CONTRACT, TORT, OR ANYTHING ELSE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THAT PERIOD AND (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent the law allows. These terms do not limit liability for death or personal injury caused by negligence, or for fraud, where the law forbids that limit.

Indemnity

You will indemnify and hold harmless Tobin and its operators, suppliers, and personnel from claims, damages, losses, and reasonable legal fees arising out of: your offer or your business; messages sent from your accounts; a collaboration, visit, or shipment; your breach of these terms or of a platform’s terms; your violation of law, including anti-spam and advertising-disclosure rules; or a dispute between you and a creator or platform. We may control the defense of a claim that is covered here, and you will cooperate.

Ending access

You may stop using Tobin at any time and ask us to close the account. We may suspend or end access if you break these terms, if we must do so for safety or legal reasons, or if we discontinue the beta. Sections that should survive — including disclaimers, liability limits, indemnity, and the license you gave us to retain records we are required to keep — will survive.

General

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Courts in Toronto, Ontario, have exclusive jurisdiction, except that we may seek an injunction anywhere for misuse of the service.

If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms are the whole agreement about the service and replace earlier discussions about the same subject. You may not assign them without our consent. We may assign them as part of a reorganization or sale of the service.

We may update these terms by posting a new version on this page. If a change is material, we will make a reasonable effort to tell account holders. Using Tobin after the update means you accept it.
